Artificial intelligence is rapidly reshaping the landscape of the insurance industry. With record profits giving them more resources, companies are pouring heavy capital into integrating AI directly into their core platforms. From automating repair estimates and parsing coverage terms to detecting fraudulent, AI-generated images, carriers are eager to modernize.

As deepfakes and doctored claim photos become the leading trend in insurance fraud, carriers are relying on advanced algorithms to catch manipulated documentation. In today’s market, the consensus is clear: whichever side best leverages AI will come out ahead.

Yet, this technological race isn’t happening in a vacuum— home and property owners are deploying the exact same tools to take control of their coverage.

The Policy Transparency Gap

Insurance policies are notoriously complex, heavily conditional, and often intentionally vague. They aren’t designed to be read cover-to-cover like a book. Instead, a single clause might direct you to an endorsement, which sends you to a section on exclusions, which then hinges on a narrow definition located elsewhere in the document. You have to navigate a maze of coverage terms, exceptions to exclusions, and conditional limitations just to determine if a fallen tree branch is covered.

Historically, policyholders facing a loss had very few places to turn for objective guidance:

Insurance Agents

Agents sell policies, but when asked to interpret coverage during a loss, they are usually trained to deflect and refer the client to an adjuster.

General Contractors (GCs)

In many jurisdictions, a contractor cannot advise on policy coverage without illegally acting as an unlicensed Public Adjuster (PA). In states like Minnesota, for instance, strict conflict-of-interest laws prohibit anyone from acting as both a GC and a PA on the same claim.

Public Adjusters (PAs)

While licensed to advocate for policyholders, hiring a PA often comes with a steep price tag—typically 10% to 25% of the total claim payout.

Left in a vacuum between rigid policy language and strict legal boundaries, policyholders have long been at a clear disadvantage. How often does a homeowner need to read through their policy and if an adjuster misinterprets the policy who can they turn to for help? Sometimes their agent can help but most of the time they are directed by the agent to “talk to the adjuster.”

How Policyholders Are Flipping the Script with AI

Rather than accepting an initial denial at face value, policyholders are now taking matters into their own hands. By feeding their policy documents into AI models, homeowners are turning complex legal jargon into clear, actionable insights.

The Legal Advantage: Ambiguity and Aleatory Contracts

In the world of insurance adjusting, policy debates are common because policies are routinely subject to multiple valid interpretations. When language is ambiguous, the law typically favors the consumer.

Because insurance policies are aleatory contracts—agreements where performance depends on an uncertain event—and contracts of adhesion (written entirely by one party), legal precedent dictates that any inherent ambiguity must be interpreted in favor of the policyholder, not the insurer who drafted the agreement.

Is AI 100% perfect? No. It can occasionally misinterpret nuance or hallucinate details. However, by surfacing subtle ambiguities and giving homeowners the vocabulary to ask the right questions, AI provides a powerful, low-cost tool that finally levels the playing field.
